Drone Imaging Privacy Policy

Scott Hussey Photography values the privacy of every client and non-participating person whom our operations affect. As a provider capturing images from an aerial perspective, it is expected that, from time to time, images of non-participating individuals may appear in the collateral that is captured.

For our purposes, when determining behaviors that may be considered “violation of privacy”, Scott Hussey Photography uses New Hampshire RSA 644:9 as a guide.  “Reasonable expectation of privacy” was defined by the U.S. Supreme Court in Katz v United States.

It is the policy of Scott Hussey Photography that a model release be obtained prior to the publication of any image containing a recognizable human being and/or physical area where an individual has a reasonable expectation of privacy. If imaging is performed in a public space where, under both federal and state laws, an individual does not have a reasonable expectation of privacy, Scott Hussey Photography will make every effort to respect the non-identification of individuals unless the publication of such collateral is necessary for the reporting of timely news media.

If imaging is performed of a private residence under contract to Scott Hussey Photography, every effort will be made to limit the imaging obtained to that property specified in the relevant service agreement. If that is not possible, we will ensure that no images are captured of spaces that are internal to another private residence or of human beings in any section of their property where they could have a reasonable expectation of privacy.

Finally, it is the policy of Scott Hussey Photography that NO imaging will occur of any individual and/or physical area where a reasonable expectation of privacy exists. We do not conduct or contract our services to any entity – whether private or public – for the purposes of surveillance, tracking, or identification.  The only exception to this practice will be to assist public and private organizations in legitimate search and rescue activities.

Scott Hussey Photography reserves the right to update this policy at any time in accordance with federal, state, and local laws.
